War Service: May 1861 Capt. in 16th US Infantry, October 1861 Col. of 63rd Pennsylvania, Peninsula campaign, Seven Pines, Seven Days, Second Bull Run (w), September 1862 appointed Brig. Gen. of Volunteers, Washington defenses, commanded 3rd Divn/III Corps at Gettysburg, commanded 2nd Bde/3rd Divn/II Corps at Wilderness (k).

Post War: Hays was killed in action near the junction of the Brock and Plank Roads in the Wilderness, 1864
